These Terms of Service ("Terms") govern your access to and use of the website and services provided by 3G Leads LLC, operating as AI-Smart Agency ("AI-Smart Agency," "we," "us," or "our"). By using our services, you agree to these Terms.
AI-Smart Agency provides AI-powered communication infrastructure, which may include AI voice agents, AI SMS/text messaging, AI email, a CRM, automations, and related tools. Features available to you depend on your selected plan.
You must be at least 18 and able to form a binding contract. You are responsible for your account, your login credentials, all activity under your account, and the accuracy of the information you provide.
Our services use artificial intelligence and automation to place and receive calls and to send and receive texts and emails. You acknowledge that:

You are solely responsible for the contacts you upload and the messages and calls you initiate, and you will not use the services for unsolicited or unlawful communications.
You will not use the services to send spam or unlawful, harassing, deceptive, or infringing content; to violate any law or third-party right; or to transmit malware or interfere with the services. We may suspend or terminate access for violations.
Plans are billed monthly in advance unless stated otherwise. Free-trial terms (where offered) are described at sign-up; if you do not cancel before the trial ends, your plan converts to paid at the then-current rate. You authorize us and our payment processor to charge your payment method for plan fees and usage charges. Fees are non-refundable except where required by law. You may cancel as described in your account; cancellation stops future renewals.
Your plan covers platform access and the features listed for your tier. Usage is billed separately on a pay-as-you-go basis and is not unlimited. Usage charges are billed in addition to your monthly plan fee, based on actual consumption at the then-current standard rates:

AI voice and AI conversation usage are billed separately from standard call and text rates. A2P registration fees and call-transcription charges are not included and may be billed separately. Rates are based on current third-party provider pricing, may vary by region, and may change; continued use after a change constitutes acceptance.
We provide tools and infrastructure. We do not guarantee any particular number of leads, appointments, sales, deliverability, uptime, or other results. Outcomes depend on many factors outside our control.
The services rely on third parties (for example, telephony carriers, AI/model providers, the hosting platform, and payment processors). Your use may be subject to their terms, and their availability and pricing may affect the services.
We and our licensors own the services, software, and content (excluding your data and content). You receive a limited, non-exclusive, non-transferable right to use the services per these Terms. You retain rights to your own data and content.
The services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, AI-Smart Agency and 3G Leads LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the services will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.
You will defend, indemnify, and hold harmless AI-Smart Agency and 3G Leads LLC from claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the services, your content and contacts, or your violation of these Terms or of any law, including consent, telemarketing, messaging, and call-recording laws.
You may stop using the services at any time. We may suspend or terminate access if you violate these Terms, fail to pay, or create risk or legal exposure. Provisions that by their nature should survive (including amounts owed, disclaimers, limitation of liability, and indemnification) survive termination.
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use after changes become effective constitutes acceptance.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Texas, unless otherwise required by law.
